The use of content of BioImmersion’s website knowledge is expressly conditioned on your acceptance of the following Terms and Conditions. If you do not agree with all of the Terms and Conditions, please do not register as a customer or use BioImmersion information.

BioImmersion Inc. reserves the right to modify these Terms and Conditions at any time. Continuing on to use the website offerings constitutes your acceptance of the Terms and Conditions, and any revisions to these Terms and Conditions. Please check this page regularly.

 

Terms of Sale for Health Care Practitioners

 

• BioImmersion reserves the right to change the pricing of its products at any time and without advance notice.
• Products will be shipped according to the standard methods of shipping that BioImmersion has in place at the time.
• Packages are delivered Monday to Friday. A Saturday delivery is also possible.
• Packages are delivered during business hours and require your signature unless you request delivery without signature, in which case you will be responsible for lost packages delivered to you. Since all couriers consider their delivery record as conclusive proof of delivery, make sure you track your packages and are in your shipping address during the time of delivery.
• When a product is received in a damaged condition or there is any discrepancy between the item or quantity ordered, and what was sent, it should be reported immediately upon receipt of products to BioImmersion Customer Service for authorization to return and exchange products.
• BioImmersion Inc. must receive the preapproved returned product before a product credit will be issued and within seven days.
• BioImmersion is not responsible for any returns that are lost in the mail when you ship back to us.
• Except in the case of damaged or mistake made by BioImmersion, unfortunately and without exception, BioImmersion cannot accept returns of any products. Please consider before choosing a therapeutic food product. We follow strict guidelines to maintain freshness, to conserve environmentally (energy, resources, fuel toxins, packing materials, etc.), and serve all our customers equally.
• International Shipping: BioImmersion is not responsible for any packages held by international customs agencies. Check with your country’s agencies to determine laws, procedures, and potential charges, such as duties or other fees. If BioImmersion is mistakenly invoiced by your country’s agency, we will email the invoice to you to be paid.

Reselling BioImmersion Products online: The online retail pricing policy (MAP policy).

MAP is the Minimum Advertised Price, which is the price that is designated for each product in BioImmersion’s current Retail Price List (online and on paper). The Minimum Advertised Price for each product is unilaterally set by BioImmersion and this price is not subject to negotiation.

The MAP policy applies to every customer who resells BioImmersion products online.

The MAP Policy prohibits volume discounting online or any other promotion that would cause the unit price of a product to be advertised online at less than the designated Retail Price for that product.

BioImmersion Inc. reserves the right not to sell its products to any customer who is affiliated with a website that violates the online retail pricing policy. A violation of this policy is grounds for suspension of a customer's account.

In case of repeated violation of the online retail pricing policy, BioImmersion Inc. reserves the right to revoke any wholesale or retail purchasing privileges and, without notice, take any additional action it deems necessary against an individual that violates the policy.

The MAP policy applies to online sales, but not to advertising direct from the practitioner's office to their private patient base.

Use of BioImmersion Trademarks, product pictures, and description on the Internet

Images and likenesses of BioImmersion’s trademarks and pictures of bottles bearing BioImmersion labeling, and product descriptions can be downloaded from the website by professional customers who have opened a BioImmersion customer account and asked for BioImmersion permission.

A customer does not have the right to affix any BioImmersion trademark to any product or other material that is not a BioImmersion dietary supplement product.

The use of a BioImmersion trademark does not give a customer any ownership right, title, or interest, in the trademark.

The BioImmersion logo and the names of various products of BioImmersion are trademarks of BioImmersion Inc. Please request permission before using any BioImmersion materials.
